AT ABOUT 8:45 A.M. ON JANUARY 22, 1991, EMPLOYEE #1, AN EMPLOYEE OF W.H. EBERT CORP., WAS CROSSING A CONCRETE-LINED DRAINAGE CHANNEL 10 FEET WIDE BY 9 FEET DEEP. EMPLOYEE #1 AND ANOTHER EMPLOYEE USED A LADDER TO CLIMB DOWN INTO THE CHANNEL AND THEN UP THE OTHER SIDE, EACH HOLDING THE LADDER STEADY FOR THE OTHER PERSON. ON THE RETURN TRIP, EMPLOYEE #1 GOT INTO THE CHANNEL WITHOUT THE OTHER EMPLOYEE STEADYING THE LADDER AGAINST MOVEMENT. AS A RESULT, THE LADDER FELL OVER, THROWING EMPLOYEE #1 TO THE BOTTOM OF THE CHANNEL WHERE HE WAS INJURED. THE JOB SITE FOREMAN WAS STANDING CLOSE BY AND WATCHING THE TWO MEN.
