La oficina de área en Portland de la Administración de Seguridad y Salud Ocupacional (OSHA) del Departamento de Trabajo de los Estados Unidos de América y el Consulado de México en Portland, Oregon en adelante denominados conjuntamente “los Participantes”;

RECONOCIENDO el compromiso conjunto de proteger los derechos de los trabajadores mexicanos en los Estados Unidos; y

RECONOCIENDO que el Programa de Alianza de la OSHA prevé el establecimiento de relaciones de cooperación para fines tales como la capacitación y la educación, difusión y comunicación, y para promover un diálogo nacional sobre la seguridad y la salud en el trabajo;

Se proponen establecer una Alianza para lograr lo siguiente:

Objetivo General

Los Participantes tienen la intención de establecer una relación de colaboración para proveer a los nacionales mexicanos y a otros en Oregon información, orientación y acceso a recursos de capacitación y educación para promover los derechos de los trabajadores a la protección de su seguridad y salud ocupacionales, y para ayudarlos a entender la ley nacional de los Estados Unidos de América sobre los derechos de los trabajadores y las responsabilidades de los empleadores al amparo de la Ley de Seguridad y Salud Ocupacionales (OSH Act).

Capacitación y Educación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de capacitación y educación:

  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon sobre la seguridad y la salud en el lugar de trabajo.
  • Elaborar programas de capacitación y educación para los empleadores y los trabajadores mexicanos en Oregon a fin de promover el entendimiento de los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act, incluyendo el uso del procedimiento de quejas de OSHA.
Difusión y Comunicación

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos de difusión y comunicación:

  • Elaborar información sobre el reconocimiento y la prevención de riesgos en el lugar de trabajo, y formular mecanismos para comunicar dicha información (por ejemplo, por medios impresos y electrónicos, herramientas de asistencia electrónica y enlaces al sitio Web de la OSHA desde el sitio Web del Consulado), a los nacionales mexicanos que trabajan en Oregon y a sus empleadores.
  • Dar discursos, realizar exposiciones o presentarse en las conferencias, reuniones locales u otros eventos de los Participantes.
  • Participar en las actividades y los eventos del “Consulado Móvil”.
Promoción de un Diálogo Nacional

Los Participantes tienen la intención de trabajar conjuntamente para lograr los siguientes objetivos relacionados con la promoción de un diálogo conjunto sobre la seguridad y la salud en el lugar de trabajo:

  • Dar a conocer y demostrar el compromiso con la seguridad y la salud en el lugar de trabajo y los derechos de los trabajadores siempre que los funcionarios principales de los Participantes se dirijan al público.
  • Convocar o participar en foros, debates en mesas redondas o reuniones de interesados principales sobre cuestiones que afectan a los nacionales mexicanos que trabajan Oregon para ayudar a forjar soluciones innovadoras sobre cuestiones relativas a la seguridad y la salud en el lugar de trabajo, y el entendimiento los derechos de los trabajadores y las responsabilidades de los empleadores al amparo del OSH Act.

Un grupo de implementación, integrado por representantes de cada Participante, tiene la intención de reunirse para elaborar un plan de acción, determinar los procedimientos de trabajo y establecer las funciones y responsabilidades de los Participantes. Además, los Participantes tienen el propósito de reunirse por lo menos tres veces al año con fines de seguimiento e intercambio de información sobre las actividades y los resultados en torno al logro de los objetivos de la Alianza.

Nada de lo dispuesto en el presente Arreglo compromete a los Participantes a erogar recursos.

Este Arreglo puede iniciarse una vez firmado por los dos Participantes. El presente Arreglo puede durar dos (2) años a partir de la fecha de su firma. El Participante que tenga la intención de dar por terminado el presente Arreglo procurará notificar por escrito al respecto con treinta (30) días de antelación. El presente Arreglo podrá modificarse por escrito en cualquier momento mediante el consentimiento mutuo de los Participantes

AND
THE CONSULATE OF MEXICO IN PORTLAND, OREGON


The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Portland Area Office and the Consulate of Mexico in Portland, Oregon (the Consulate), hereinafter referred to collectively as “the Participants”;

RECOGNIZING the joint commitment to protect workers’ rights for Mexican workers in the United States; and

RECOGNIZING that OSHA’s Alliance Program provides for the establishment of cooperative relationships for purposes such as training and education, outreach and communication, and promoting a national dialogue on workplace safety and health;

Intend to form an Alliance to achieve the following:

Overall Objective

The Participants intend to establish a collaborative relationship to provide Mexican Nationals in Oregon and others information, guidance, and access to education and training resources to promote workers’ rights in protecting their occupational safety and health, and to help them understand U.S. domestic law on the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

Training and Education

The Participants intend to work together to achieve the following training and education goals:

  • To develop training and education programs for Mexican workers and Mexican employers in Oregon regarding workplace safety and health.
  • To develop training and education programs for Mexican workers and Mexican employers in Oregon to promote understanding of workers’ rights and responsibilities of employers under the OSH Act, including the use of the OSHA complaint process.
Outreach and Communication

The Participants intend to work together to achieve the following outreach and communication goals:

  • To develop information on the recognition and prevention of workplace hazards, and to develop ways of communicating such information (e.g., print and electronic media, electronic assistance tools, and links to OSHA’s Web site from the Consulate’s Web site) to Mexican Nationals working in Oregon and their employers.
  • To speak, exhibit, or appear at the Participants’ conferences, local meetings, or other events.
  • To participate in “Mobile Consulate” activities and events.
Promotion of a National Dialogue

The Participants intend to work together to achieve the following goals related to promoting a joint dialogue on workplace safety and health:

  • To raise awareness of and demonstrate commitment to workplace safety and health and workers’ rights under the OSH Act whenever leaders from the Participants address groups.
  • To convene or participate in forums, roundtable discussions, or stakeholder meetings on issues affecting Mexican Nationals working in Oregon to help forge innovative solutions on issues concerning workplace safety and health and understanding of workers’ rights and responsibilities of employers under the OSH Act.

An implementation team made up of representatives of each Participant intends to meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the Participants. In addition, the Participants intend to meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance.

Nothing in this Arrangement commits the Participants to the expenditure of any funds.

This Arrangement may commence upon signature by both Participants. This Arrangement may continue for two (2) years from the date of signing. A Participant should endeavor to provide thirty (30) days advanced written notice of its intent to discontinue the Arrangement. This Arrangement may be modified in writing at any time by mutual consent of the Participants.

AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN

KANSAS CITY AND THE SAINT LOUIS AREA OFFICES
AND
MISSOURI ASSOCIATION OF MANUFACTURERS (MAM)


The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Kansas City and the Saint Louis Area Offices and Missouri Association of Manufacturers (MAM) recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and MAM hereby form an Alliance to provide the MAM Members (including, Current Members, Prospective Members, and MAM’s Partners, Alliances, and Affiliates) with information, guidance, and access to training resources that will help them protect and address workers by reducing and preventing exposure to hazards including, but not limited to: amputations, lacerations or punctures, lockout/tagout hazards, machine guarding, heat stress, falls, struck-by, caught-in/between, ergonomics and electrical hazards), and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and MAM recognize that OSHA’s State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach, Communication

The Participants intend to work together to achieve the following objective(s):

  • Share information on OSHA’s National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, and Outreach) and opportunities to participate in initiatives and the rulemaking process.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards and communicate such information (e.g., print and electronic media, electronic assistance tools, OSHA and MAM’s website and social media pages) to employers and workers in the industry as appropriate.
  • Speak, exhibit, or appear at OSHA and MAM conferences, summits, webinars, virtual meetings, local and regional meetings, or other MAM hosted/sponsored meetings and events.
  • OSHA will attend MAM’s public safety, and health annual conferences, to provide compliance assistance information focused on the manufacturing hazards to help them to reduce fatalities, injuries and illnesses in the manufacturing professional organizations.
  • Convene or participate in forums, roundtable discussions, or stakeholder meetings on safety, health, and environmental topics and hazards to help forge innovative solutions in the workplace or to provide input on safety and health issues.
  • Share information among OSHA personnel and industry safety and health professionals regarding MAM’s good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Encourage worker participation in workplace safety and health by providing messaging, education, and training through communication channels.
  • MAM with OSHA’s assistance will be working in a collaborative manner with other Alliance participants on specific issues or challenges related to safety, and health, including manufacturers and manufacturing professional organizations, as described in the work plan.
  • MAM will develop and disseminate case studies on safety health and environmental topics and publicize their results with the alliance members.
  • Encourage MAM’s members and prospective members to build relationships with OSHA’s Regional and Area Offices to address safety, and health issues.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • MAM with OSHA’s assistance are going to work in a collaborative manner to develop effective training and education through programs and events for manufacturers and/or related industries regarding safety, and health hazards and risks, and to communicate such information to constituent employers and workers, as described in the work plan.
  • MAM with OSHA’s assistance are going to develop effective training and education programs for manufacturers and/or related industries to promote understanding of workers’ rights, including the use of the OSHA complaint process, the responsibilities of employers, and communication of such information to workers and employers.
  • Participate in MAM events, programs, and other workshops as applicable:
    • Events which include, but not limited to: MAM’s annual events: Mid-America Safety Health & Environmental Conference (MASHE), Gearing Up Conference & Annual Meeting, Manufacturing Summit, and Manufacturing for Women Conference.
    • Programs which include but not limited to: MAM’s Innovation Teams and OneSource Programs (i.e. PROTECTSource, SUPPORTSource)
    • Development of messaging opportunities to include, but not limited to: website, blog, onsite or virtual training, social media, newsletters, and other applicable communication methods.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services. An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Kansas City and the Saint Louis Area Offices. OSHA will encourage State Plan and OSHA On-Site Consultation program participation on the team. This agreement will remain in effect for two years. Either signatory may terminate for any reason at any time, provided 30 days written notice is provided. This agreement may be modified at any time with the written concurrence of both signatories.

The U.S. Department of Labor’s Occupational Safety and Health Administration (OSHA) Allentown Area Office (AAO), the Pennsylvania OSHA Consultation Program and Upper Bucks County Technical School (UBCTS) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and UBCTS hereby renew the Alliance signed September 17, 2015 and renewed September 14, 2017, with a continued emphasis on outreach and education for your/student workers. Specifically, all organization(s) are committed to providing UBCTS students, faculty, administration members Occupational Advisory Council members and others with information, guidance, and access to training resources that will help them protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address workplace hazard awareness, safety and health program management and implementation and the hierarchy of controls to reduce or prevent workplace hazards.

This agreement provides a framework and objectives for the Alliance’s activities. Alliance participants also agree to meet the requirements for program participation laid out in the “Fundamental Requirements for OSHA Alliance Program Participants” and the “Guidelines for OSHA’s Alliance Program Participants: Alliance Products and Other Alliance Projects.”

  • To review and provide input on effective training and education curricula for youth entering the workforce to promote understanding of workers’ rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
  • To deliver various safety and health related training and education on topics including but not limited to: understanding worker rights; hazards associated within the construction trades, specifically: falls, struck-by conditions, caught-in/between hazards, and electrical hazards; hazards associated within the healthcare industry, material handling hazards, use of personal protective equipment and hazards associated with chemicals.

OSHA’s Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA’s initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering into an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote, any of that organization’s products or services.
