AGREEMENT ESTABLISHING AN ALLIANCE
BETWEEN

THE OCCUPATIONAL SAFETY AND HEALTH ADMINISTRATION

ILLINOIS MANUFACTURERS' ASSOCIATION (IMA)
AND

ILLINOIS ON-SITE CONSULTATION PROGRAM

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Chicago North, Chicago South, Fairview Heights, Naperville, and Peoria Area Offices and the Illinois Manufacturers' Association (IMA) and the Illinois On-Site Consultation Program recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA, IMA, and Illinois On-Site Consultation hereby form an Alliance to provide IMA members and the public with information, guidance, and access to training resources that will help protect workers by reducing and preventing hazards associated with operating food production machinery and performing service, maintenance, cleaning and sanitation, inspection, and quality assurance tasks on food processing and ancillary equipment. The Alliance will promote effective guarding systems, hazardous energy control methods, and comprehensive hazard communication training, while also fostering an understanding of workers' rights and employers' responsibilities under the Occupational Safety and Health Act (OSH Act), as outlined in the attached Alliance work plan.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use available injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to member surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In developing this Alliance, OSHA and IMA recognize that the Illinois On-Site Consultation Program is an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with this partner for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

• Share information on OSHA's National/Regional/Local Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and rulemaking process.
• Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
• Speak, exhibit, or appear at OSHA and IMA meetings or other outreach events.
• Ensure Alliance activities are informed by the perspectives of non-managerial workers and local collective bargaining agents in the industry.

Training and Education

The Participants intend to work together to achieve the following objectives:

• Develop effective training and education programs for participants on workplace hazards and communicate information to constituent employers and workers. Ensure training materials/programs are made available in appropriate languages and formats to equitably meet the needs of their target audiences.
• Develop effective training and education programs for participants to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.

OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. By entering an Alliance with an organization, OSHA is not endorsing or promoting, nor does it intend to endorse or promote any of that organization's products or services.

An implementation team made up of representatives of each organization will meet to develop a plan of action, determine working procedures, and identify the roles and responsibilities of the participants. In addition, they will meet at least three times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives from the OSHA Chicago Region Area Offices and any other appropriate member representative. OSHA will encourage Illinois On-site Consultation Program participation in team activities.

This agreement will remain in effect for two years. Either signatory may terminate their organization's participation in the agreement for any reason at any time, provided they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of both signatories.

Since entering into an Alliance on October 24, 2018 with subsequent renewal(s) on and August 1, 2022, the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Naperville, Chicago North and Chicago South Area Office and Chicagoland Associated General Contractors (Chicagoland AGC) have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

OSHA and Chicagoland AGC continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces and commit to continue their work together through an Alliance Program Ambassador relationship.

In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with Chicagoland AGC by:

• Providing routine communications on enforcement, regulatory, and outreach initiatives.
• Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Construction Roundtable and Forum.
• Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
• Maintaining the organization's status as Alliance Program Ambassador on the agency's public webpage.

Chicagoland AGC will continue to foster an active relationship with OSHA by:

• Sharing information with members and stakeholders on OSHA's National Initiatives (Enforcement, Regulatory, and Outreach) and encouraging their participation in OSHA's outreach initiatives and rulemaking processes.
• Sharing information with members and stakeholders on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
• Encouraging Chicagoland AGC chapters and worksites to build relationships with OSHA's National, Regional and Area Offices to address health and safety issues.
• Sharing information with OSHA personnel and industry safety and health professionals regarding Chicagoland AGC good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
• Offering OSHA opportunities to speak, exhibit, or appear at one another's conferences, local meetings, or other events.
• Adhering to requirements laid out in the Alliance Program Directive regarding the prohibition on promoting or implying the agency's endorsement of their policies, products, or services, including acknowledging that they will not receive any preferential treatment related to any statutory function of the agency.
• Abiding by all terms and conditions for the use of the Alliance Program logo as specified in OSHA's Guidelines for Use of the Alliance Logo.

OSHA's cooperative programs provide organizations an opportunity to participate in a voluntary, collaborative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These programs have proven to be valuable tools for both OSHA and participants. OSHA and Chicagoland AGC acknowledge that this document is not legally binding. This document does not obligate or authorize the expenditure or reimbursement of appropriations or other funds, nor does it require the parties to enter into any contract or other obligations. It does not confer any rights or responsibilities under U.S. law, nor does it limit or restrict the parties from participating in similar activities or arrangements with other entities. This document does not limit, supersede, or otherwise affect OSHA's normal operations or decisions in carrying out its statutory and regulatory duties and functions. OSHA's entering this relationship with an organization does not imply the agency's endorsement or promotion of that organization's products or services.

This Ambassador relationship will be executed in full compliance with all applicable federal laws. It takes effect on the date of signing and will remain in effect for the duration of an ongoing cooperative association and a good faith effort by all parties to meet the intent of this document and its underlying policies. Either signatory may terminate it for any reason at any time, provided they give 30 days' written notice. Termination by one signatory will not nullify the Ambassador relationship with all signatories, with the exception of OSHA; OSHA may terminate the Ambassador relationship as a whole, or its relationship with one or more individual signatories.

To that end, OSHA and Pipefitters Local 597 hereby form an Alliance to provide Pipefitters Local 597 and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to, including but not limited to, the hazards of falls, trenching, struck-by and welding and understanding the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

This agreement provides a framework and objective for the Alliance's activities. Alliance participants also agree to meet the "Fundamental Requirements for OSHA Alliance Program Participants' and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects".

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
• Speak, exhibit, or appear at OSHA and Pipefitters Local 597 conferences, local meetings/round table discussions, or other events.
• Share information among OSHA personnel and industry safety and health professionals regarding Pipefitters Local 597 good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
• To encourage worker participation in workplace safety and health by speaking at Local 597 OSHA 10- and 30-hour courses.
• Develop and share resources in the workplace hazard recognition and prevention, ensuring clear and effective communication with employers and workers across the industry.
• Facilitate knowledge sharing among OSHA personnel and safety professionals by organizing training programs, workshops, seminars, and industry discussions to highlight best practices and effective safety strategies.

Training and Education

The Participants intend to work together to achieve the following objectives:

• Work with OSHA to provide expertise to develop training and education programs for OSHA compliance officers (CSHO's) and Local 597.
• To develop effective training and education programs for Local 597 members to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers.
• To deliver or arrange for the delivery of the OSHA portion for OSHA 10 and 30-hour courses.

OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. In entering this Alliance, OSHA and Pipefitters Local 597 acknowledge that this agreement is not legally binding. The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Appleton, Eau Claire, Madison, and Milwaukee Area Offices, Wisconsin Safety and Health Consultation Program, and Wisconsin Underground Contractors Association, Inc. (WUCA) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA, Wisconsin Safety and Health Consultation Program, and WUCA hereby renew the Alliance signed April 21, 2023, and renewed March XX, 2026, with a continued emphasis on protecting workers in the underground construction industry. Specifically, each organization is committed to providing WUCA members and the public with information, guidance, and access to training resources that will help them protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will continue to address hazards associated with trench cave-ins, underground utility strikes, confined space entries, struck-by equipment and material, respirable silica, heat illness, and roadway work zones.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projectsp."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. • Convene or participate in forums, roundtable discussions, or stakeholder meetings on underground construction to help forge innovative solutions in the workplace or to provide input on safety and health issues.
• Share information among OSHA personnel and industry safety and health professionals regarding WUCA's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
• Ensure Alliance activities are informed by the perspectives of non-managerial workers employed in the underground construction industry by encouraging worker participation in workplace safety and health.
• Collaborate with other Alliance participants on specific issues and projects on the underground construction industry.
• Develop and disseminate case studies on trenching and publicize their results.
• Encourage WUCA members to build relationships with OSHA's Regional and Area Offices to address health and safety issues, including trenching, struck-by, underground utilities, confined space entry, and roadway work zone safety.

Training and Education

The Participants intend to work together to achieve the following objectives:

• Develop effective training and education programs for the underground construction industry regarding trenching, struck-by equipment and materials, respirable silica, heat illness, underground utilities, confined space entry and roadway work zone safety, and communicate such information to constituent employers and workers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.
• Develop effective training and education programs for the underground construction industry to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.
