Since entering into an Alliance on September 02, 2011, with subsequent renewals on June 21, 2019 and October 19, 2022, the U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) San Antonio Area Office and The Hispanic Contractors de San Antonio (HCA) have worked together to improve workplace health and safety by sharing information, guidance, and access to training resources that address occupational hazards, and promoting understanding of the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act.

OSHA and HCA continue to recognize the value of maintaining a collaborative relationship to improve safety and health practices and programs in American workplaces, and commit to continue their work together through an Alliance Program Ambassador relationship.

In recognition of this ongoing commitment, OSHA will continue to foster an active relationship with HCA by:

  • Providing routine communications on enforcement, regulatory, and outreach initiatives.
  • Sharing invitations to and offering opportunities to speak at OSHA Alliance Program and other agency stakeholder meetings or events, such as outreach and training activities through the National, Regional, or Area Office, and the National Alliance Program Construction Roundtable and Forum.
  • Engaging in information sharing and technical discussions, as appropriate, including completing special projects of mutual interest that align with agency priorities and as resources allow.
  • Maintaining the organization's status as Alliance Program Ambassador on the agency's public webpage.

HCA will continue to foster an active relationship with OSHA by:

  • Sharing information with members on OSHA's National Initiatives (Enforcement, Regulatory, and Outreach) and encouraging their participation in OSHA's outreach initiatives and rulemaking processes.
  • Sharing information with members on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Encouraging HCA chapters to build relationships with OSHA's National, Regional and Area Offices to address health and safety issues.
  • Sharing information with OSHA personnel and industry safety and health professionals regarding HCA good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Offering OSHA opportunities to speak, exhibit, or appear at one another's conferences, local meetings, or other training events.
  • Adhering to requirements laid out in the Alliance Program Directive regarding the prohibition on promoting or implying the agency's endorsement of their policies, products, or services, including acknowledging that they will not receive any preferential treatment related to any statutory function of the agency.
  • Abiding by all terms and conditions for the use of the Alliance Program logo as specified in OSHA's Guidelines for Use of the Alliance Logo.

OSHA's cooperative programs provide organizations an opportunity to participate in a voluntary, collaborative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communication, training, and education. These programs have proven to be valuable tools for both OSHA and participants. OSHA and HCA acknowledge that this document is not legally binding. This document does not obligate or authorize the expenditure or reimbursement of appropriations or other funds, nor does it require the parties to enter into any contract or other obligations. It does not confer any rights or responsibilities under U.S. law, nor does it limit or restrict the parties from participating in similar activities or arrangements with other entities. This document does not limit, supersede, or otherwise affect OSHA's normal operations or decisions in carrying out its statutory and regulatory duties and functions. OSHA's entering this relationship with an organization does not imply the agency's endorsement or promotion of that organization's products or services.

This Ambassador relationship will be executed in full compliance with all applicable federal laws. It takes effect on the date of signing and will remain in effect for the duration of an ongoing cooperative association and a good faith effort by both parties to meet the intent of this document and its underlying policies. Either signatory may terminate it for any reason at any time, provided they give 30 days' written notice.

AGREEMENT RENEWING AN ALLIANCE
BETWEEN

AND
ROOFING CONTRACTORS' ASSOCIATION OF SOUTH FLORIDA (RCASF)

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA), Fort Lauderdale Area Office and Roofing Contractors Association of South Florida (RCASF) continue to recognize the value of maintaining a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and RCASF hereby renew the Alliance signed November 15, 2023, with a continued emphasis on reducing and preventing exposure to falls, struck-by, chemical and electrical hazards, as well as other prevalent safety and health hazards in the roofing industry. Specifically, OSHA and RCASF are committed to providing RCASF members and the public with information, guidance, and access to training resources that will help them protect workers and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act). Through the Alliance, the organizations will also continue to address hazards related to scaffolding, confined space, and heat illness.

This agreement provides a framework and objectives for the Alliance's activities. Alliance participants also agree to meet the requirements for program participation laid out in the "Fundamental Requirements for OSHA Alliance Program Participants" and the "Guidelines for OSHA's Alliance Program Participants: Alliance Products and Other Alliance Projects."

Through the Alliance, the organizations will use injury, illness, and hazard exposure data, when appropriate, to help identify areas of emphasis for Alliance awareness, outreach, and communication activities. The Alliance will also explore and implement selected options, including but not limited to surveys, to evaluate the Alliance and measure the impact on improving workplace safety and health. In renewing this Alliance, OSHA and RCASF recognize that OSHA's State Plan and On-Site Consultation Program partners are an integral part of the OSHA national effort, and that information about the products and activities of the Alliance may be shared with these partners for the advancement of common goals.

Raising Awareness: Outreach and Communication

The Participants intend to work together to achieve the following objectives:

  • Share information on OSHA's National Initiatives (Emphasis Programs, Regulatory Agenda, Outreach), and opportunities to participate in initiatives and the rulemaking process.
  • Share information on occupational safety and health laws and standards, including the rights and responsibilities of workers and employers.
  • Develop information on the recognition and prevention of workplace hazards, and communicate such information (e.g., print, and electronic media, electronic assistance tools, and OSHA and the RCASF websites) to employers and workers in the industry. Ensure information developed reflects the workforce and is available in multiple languages and formats.
  • Speak, exhibit, or appear at OSHA and RCASF local meetings, or other RCASF events such as its Annual RCASF Educational Training Day.
  • Share information among OSHA personnel and industry safety and health professionals regarding RCASF's good practices or effective approaches through training programs, workshops, seminars, and lectures (or any other applicable forum).
  • Encourage RCASF members to build relationships with OSHA’s Area offices in Jacksonville, Orlando, and Tampa Florida.
Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for construction workers regarding fall protection, heat illness prevention, electrical safety, scaffolding safety, confined space safety, steel erection, struck-by, and health hazards and communicate such information to constituent employers and workers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.
  • Deliver or arrange for the delivery of safety and health training courses.
  • Develop effective training and education programs for RCASF members and others to promote understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.

OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of workplace hazards, OSHA's initiatives, outreach, communication, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants. In entering this Alliance, OSHA and RCASF acknowledge that this agreement is not legally binding. This agreement does not obligate or authorize the expenditure or reimbursement of appropriations or other funds, nor does it require the parties to enter into any contract or other obligations. It does not confer any rights or responsibilities under U.S. law, nor does it limit or restrict the parties from participating in similar activities or arrangements with other entities. An implementation team made up of representatives of each organization will meet one to two times per year to track and share information on activities and results in achieving the goals of the Alliance. OSHA team members will include representatives of the Fort Lauderdale Area Office and any other appropriate offices. OSHA will encourage State Plans' and OSHA On-Site Consultation programs' participation on the team.

This agreement will be executed in full compliance with all applicable federal laws. It takes effect on the date of signing and will remain in effect for five years. Either signatory may terminate their organization's participation in the agreement for any reason at any time, provided they give 30 days' written notice. This agreement may be modified at any time with the written concurrence of both signatories.

The U.S. Department of Labor's Occupational Safety and Health Administration (OSHA) Pennsylvania Area Offices (Allentown, Erie, Harrisburg, Philadelphia, Pittsburgh, and Wilkes-Barre) and the Pennsylvania One Call System, Inc. recognize the value of establishing a collaborative relationship to foster safety and health practices and programs to improve American workplaces. To that end, OSHA and Pennsylvania One Call System, Inc. hereby form an Alliance to provide Pennsylvania One Call System, Inc. members and the public with information, guidance, and access to training resources that will help them protect workers by reducing and preventing exposure to construction industry hazards, the impact of worksite fatalities, addressing trenching and roadway/work zone hazards, and understand the rights of workers and the responsibilities of employers under the Occupational Safety and Health Act (OSH Act).

  • Collaborate with other Alliance participants on specific issues and projects on construction hazards with an emphasis on trenching safety and sharing of Pennsylvania One Call System, Inc. handouts.

  • Encourage Pennsylvania One Call System, Inc. to build relationships with OSHA's Regional Office and other appropriate U.S. Department of Labor Agencies to address health and safety issues, including construction safety hazards, Mental Health, and suicide prevention.

Training and Education

The Participants intend to work together to achieve the following objectives:

  • Develop effective training and education programs for Pennsylvania One Call System, Inc. regarding construction safety hazard prevention specifically trenching, and communicate such information to stakeholder employers and workers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.

  • Deliver or arrange for the delivery of mini course presentations such as: Trenching Hazard Prevention and Common Construction Safety Hazards.

  • Develop effective training for Pennsylvania One Call System, Inc. to assist in promoting understanding of workers' rights, including the use of the OSHA complaint process, and the responsibilities of employers and to communicate such information to workers and employers. Ensure training materials/programs are made available in appropriate languages and formats to meet the needs of their target audiences.

OSHA's Alliances provide organizations an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as raising awareness of OSHA's initiatives, outreach, communications, training, and education. These Alliances have proven to be valuable tools for both OSHA and Alliance participants.
