AGREEMENT TO ESTABLISH AN ALLIANCE
BETWEEN THE
OCCUPATIONAL SAFETY AND HEALTH
ADMINISTRATION
TARRYTOWN, SYRACUSE, MANHATTAN, AVENEL,
LONG ISLAND/BAYSIDE, BUFFALO, AND ALBANY
AREA OFFICES,
THE NEW YORK STATE ON-SITE CONSULTATION
PROGRAM,
AND
THE NEW YORK STATE NURSES ASSOCIATION

The Occupational Safety and Health Administration (OSHA), the New York State Nurses Association (NYSNA), and the New York State Department of Labor's On-Site Consultation Program (NYS Consultation) recognize the value of establishing a collaborative relationship to foster safer and more healthful American workplaces. OSHA, NYSNA, and NYS Consultation hereby form an Alliance to provide NYSNA members and others with information, guidance, and access to training resources that will help them protect employees' health and safety, particularly in reducing and preventing worker exposures to chemical hazards, workplace violence, and ergonomic injuries in the health care industry.

OSHA, NYSNA, and NYS Consultation will work together to achieve the following training and education goals:
  • Provide NYSNA members and others with information and guidance concerning ways to protect employees' health and safety, particularly from chemical hazards, workplace violence, and ergonomic injuries.
     
  • Increase NYSNA members' access to safety and health resources by, for example, inviting participation by an OSHA Compliance Assistance Specialist and a NYS Consultation representative at the NYSNA Annual Meeting, periodic NYSNA workshops, and through the development of specific training and educational programs designed to:
     
    • identify workplace hazards using various processes such as: site safety assessments, risk mapping, and hazard/risk analysis
    • facilitate the formation of, and participation in, health and safety committees
    • develop hazard/risk mitigation strategies for nurses
    • update nurses' understanding of applicable OSHA requirements regarding:
       
      • Bloodborne Pathogens and Sharps Safety
      • Hazard Communication
      • Chemical Exposures (e.g., ethylene oxide, gluteraldehyde, mercury, latex)
      • Personal protective equipment including respiratory protection
      • Workplace Violence
      • Emergency Preparedness
  • Develop workplace safety and health "best practices" guides for NYSNA members
OSHA, NYSNA, and NYS Consultation will work together to achieve the following outreach and communication goals:
  • Pursue opportunities to jointly develop and disseminate health and safety information at the NYSNA Annual Meeting, periodic NYSNA workshops, and other venues such as the NYSNA web site and publications.
     
  • Seek opportunities to speak, exhibit, or appear at conferences, local meetings, or other NYSNA member-attended events.
     
  • Cross-train OSHA, NYS Consultation personnel, and NYSNA members in safety and health best practices, OSHA standards applicable to the health care industry, and effective means to implement such training.
OSHA, NYSNA, and NYS Consultation will work together to achieve the following goals related to promoting the national dialogue on workplace safety and health:
  • Raise each others' awareness of, and demonstrate their own commitment to, workplace safety and health whenever OSHA, NYSNA, and NYS Consultation leaders address groups.
     
  • Develop and disseminate case studies illustrating the business value of safety and health and publicize their results.
     
  • Convene or participate in forums, round table discussions, or stakeholder meetings on healthcare industry issues to help forge innovative solutions in the workplace or to provide input on safety and health issues.
To achieve the goals listed above, OSHA, NYSNA, and NYS Consultation will form an implementation team made up of representatives of all three organizations. That team will meet and develop a plan of action, determine working procedures, structure a targeted time line and identify the roles and responsibilities of the participants. The team will meet at least quarterly to track and share information on activities, review results with respect to achieving the goals and objectives of this Alliance, and modify the time line and target goals as needed. Annually, at least two of these meetings will be in person.

NYS Consultation will provide resources, as availability permits, to support the priority training and technical assistance needs of the participants of this Alliance. Such assistance, which is provided only at the request of a given employer, may be in the form of onsite or off-site safety and/or health consultations. All consultation findings will be kept confidential, so long as employer agrees to correct any serious hazards that may be identified. There are no costs to the employer for the assistance provided by NYS Consultation under this agreement.

OSHA's Alliances provide parties an opportunity to participate in a voluntary cooperative relationship with OSHA for purposes such as training and education, outreach and communication and promoting a national dialogue on workplace safety and health. These Alliances have proved to be valuable tools for both OSHA and its Alliance participants. By entering into an Alliance with a party, OSHA is not endorsing any of that party's products or services; nor does the Agency enter into an Alliance with the purpose of promoting a particular party's products or services.

This agreement will remain in effect for one year. Any Signatory may terminate it for any reason, at any time, provided they give 30 days written notice. This agreement may be modified at any time with the concurrence of all Signatories.
