Subject: Uniformity in Interpretation of 29 CFR 1926.550(a)(9)

1. Purpose

The purpose of this directive is to assure uniformity within all 10 Regions in the interpretation of 29 CFR 1926.550(a)(9)

2. Documentation Affected

This directive supersedes Field Information Memorandum #74-80 dated October 15, 1974.

3. Background

The following interpretation of 29 CFR 1926.550(a)(9) shall be used as a basis for enforcement:
a. Accessible areas within the swing radius of the rear of the rotating superstructure of the crane are meant to be those areas within the 360 degrees of travel. "A barricade is required in accessible areas when the swing radius of the rear of the rotating structure of the crane, either permanently or temporarily mounted, may cause an employee to be crushed between other objects and the rear of the crane of any portion of the crane carriage" regardless of whether it be front, rear or side.
b. Historically, most fatalities have been caused employees getting between the rotating superstructure and the turntable or other portions of the crane itself.

4. Action

This interpretation is applicable for all equipment covered under Subpart "N" of 29 CFR 1926 when used in such a manner that the hazard as described in 29 CFR 1926.550(a)(9) is created and an exposure is observed.

5. Effective Date

This directive is effective immediately and will remain in effect until canceled or superseded.
