Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm to employees in that, employees were exposed to struck-by hazards while transferring 40 foot I-beams on a rough terrain fork truck that were not clearly visible: a) On or about March 29, 2007, the employer did not ensure that employees were protected from injuries while transferring 40 foot I-beams on a rough terrain fork truck at night where the I-beams were not clearly visible or marked (reflective tape, lights). Among other methods, one feasible and acceptable abatement method to correct this hazardous condition would be to comply with ANSI B56.6-2005, section 5.7.2, by distinctively marking the I-beams or make the I-beams clearly visible.
