On January 13, 2009, Employee #1, a painter, was elevated on the platform to paint a wall at the worksite with the use of a roller. Employee #1 was elevated approximately 10 ft up on a platform, when the platform slipped off of the forks of the industrial truck. Employee #1 fell to the concrete floor and fractured his skull. He was hospitalized for more than twenty four hours. The platform was not secured to the forks or mast, in order to prevent tipping, slipping, or falling. Employee #1 was employed for approximately one week, prior to the incident. Employee #1 was directed to work by the other employee who was engaged in painting operations in another area of the worksite.
