At approximately 7:30 a.m. on February 14, 1990, Employee #1 was ordered by his supervisor to remove wood fairing strips from the deck house of a boat. The supervisor told him to use a screwdriver but this was countermanded by the owner, who ordered Employee #1 to use a crowbar to pry off the strips. Either the crowbar slipped or a fairing strip came loose unexpectedly, causing Employee #1 to lose his balance. He fell backward over the side of boat 27 ft onto a concrete floor and was killed. The area of the boat in which Employee #1 was working was not equipped with any kind of guardrail or other fall protection.
