Employee #1 was employed as a logger for a company that was logging a 70 acre tract for saw logs. Employee #1 felled a white pine from the side of a hill and then moved up the hill approximately 35 ft to cut another white pine. This pine was 120 ft tall and 32 to 34 1/2 in. diameter at the base. After the pine had been notched, it sat down on its stump instead of falling. Employee #1 did not wait for the skidder to take down the tree but moved down the hill to limb the first pine that he had felled. The lodged pine became unlodged and fell, striking Employee #1 across the neck and back. He was killed.
