Employee #1 was sitting in his 1990 Toyota 4 x 4 pickup truck, approximately 21 to 23 feet away from a tree his partner was cutting. His partner had climbed approximately 35 to 40 ft up the tree and was sawing approximately 92 ft off the top. The top of the tree was heavily laden with snow and the wind was gusting toward Employee #1. The tree was under cut and side cut, and the back was being sawed when a gust of wind blew it sideways and in the direction of Employee #1. The top of the tree landed on top of the driver's seat and struck Employee #1. He suffered brain damage and a fractured neck and was paralyzed from the neck down. Employee #1 died 39 days later. Employee #1 was positioned too close to the tree while it was being topped during the gusting wind. The tree was being topped to make a wildlife bird tree.
