29 CFR 1926.20(b)(2): The employer did not ensure that frequent and regular inspections of the job sites, materials, and equipment were conducted by a competent person: (a) On or about June 19, 2014, and at times prior, Sawtooth Enterprises, LLC., as the controlling employer, did not ensure that employees were protected from hazards related to aerial lift operations while painting a commercial structure at heights exceeding 45 feet. Sawtooth Enterprises, LLC., did not initiate or maintained an accident prevention program, that included frequent and regular inspections of the job site, materials, and equipment by a competent person. A JLG 800A aerial lift with a modified boom track was operated on a concrete surface with a side slope that exceeded the manufacturer's recommendation, exposing subcontractor employees to fall hazards in excess of 45 feet.
