29 CFR 1915.12(a)(2): Ventilation was not provided by the employer at volumes or flow rates sufficient to ensure that the oxygen content was maintained at or above 19.5 percent and below 22.0 percent by volume in spaces with oxygen-deficient atmospheres. On the Ex-U.S.S. Sirius, located at the dock, employees who were opening hatches were exposed to an oxygen deficient atmosphere and the employer did not provide ventilation. In the Alternative: 29 CFR 1910.134(d)(2)(i): The employer did not provide either a full face piece pressure demand SCBA certified by NIOSH for a minimum service life of thirty minutes or a combination full face piece pressure demand supplied-air respirator with auxiliary self-contained air supply. On the Ex-U.S.S. Sirius, located at the dock, employees who were opening hatches were exposed to an oxygen deficient atmosphere and the employer did not provide the employees with a full face piece, pressure demand SCBA or a full face piece pressure demand supplied-air respirator.
