Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, as employees were exposed to the hazard of being crushed by a riding lawn mower that is operated on terrain with unprotected ditches: (a) On or about June 3, 2014, 306 Stupell Circle, an employee was working on the lawn cutting the grass with a zero turn ride on John Deere Mini-Frame z-Trak 717 mower. The employee mowed to the edge of the drainage ditch at the bottom of the hill where the mower tipped and rolled over into the ditch crushing the employee. The employer did not provide adequate training and information to all employees who perform this work on the safe use and handling of the lawn mowing equipment, the terrain, and means and methods to protect themselves from the hazard of roll or tip over.
