29 CFR 1910.178(a)(4): Modifications and additions which affect capacity and safe operation of powered industrial trucks were performed by the employer without the manufacturer's prior written approval: On or about April 12, 2014, at the well site located near Barnhart, Texas, a materials basket was being utilized on a CAT rough terrain forklift for maintenance work being performed on a surface drilling rig. The platform was not approved by the manufacturer, did not meet the manufacturer's specifications for personnel platforms, and the operating parameters were not updated to govern the use of the platform. Employees were exposed to a fall hazard of approximately seven feet and the hazard of being struck by the unsecured materials basket. IN THE ALTERNATIVE: OSHA ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment, which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to the hazards of falls from elevations from an unapproved forklift platform: On or about April 12, 2014, a materials basket was utilized on a CAT rough terrain forklift for maintenance work on a surface drilling rig. The materials basket was not design to be used for a personnel work platform, the basket did not accommodate the insertion of the forks and it was not secured to the forklift. One feasible abatement method, among others, would be to ensure the platform conforms to the following requirements of ANSI/ITSDF B56.6-2011, Safety Standard for Rough Terrain Forklift Trucks as follows: 1) Utilize a personnel work platform approved by the manufacturer. 2) Provide a means to securely attach an approved platform to the lifting mechanism and forks, and to prevent the platform from inadvertently pivoting and sliding off. 3) Only use a rough terrain forklift truck to lift workers if there is no other practical option, such as an aerial lift.
