29 CFR 1910.120(q)(3)(iii): Based on the hazardous substances and/or conditions present, the individual in charge of the ICS did not implement appropriate emergency operations and did not ensure that the personal protective equipment worn was appropriate for the hazards encountered: Rust-Oleum Corporation, at 715 Park North Boulevard, Clarkston, GA - on or about February 3, 2014, in the filling area, employees were directed to contain and clean a spill of approximately 300 gallons of 2-butoxyethanol. The employer did not provide appropriate personal protective equipment. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
