Text For Citation: 01 Item/Group: 003A Hazard:
29 CFR 1910.120(q)(1): The employer did not develop and implement an emergency response plan to handle anticipated emergencies prior to commencement of emergency response operations: Rust-Oleum Corporation, on or about February 3, 2014, in the filling area, during transport by forklift, a tote container holding approximately 300 gallons of ethylene glycol monobutyl ether (2-butoxyethanol) was spilled near the loading ramp and the filling lines. Employees were directed to contain and clean the spill of 2-butoxyethanol, but the employer did not develop and implement an Emergency Response Plan. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
