29 CFR 1910.106(e)(3)(iv)(a): Emergency drainage systems were not provided to direct flammable liquid leakage and fire protection water to a safe location. This may require curbs, scuppers, or special drainage systems to control the spread of fire; see paragraph (b)(2)(vii)(b) of this section. Rust-Oleum Corporation, at 715 Park North Boulevard, Clarkston, GA - on or about February 10, 2014, where employees used flammable or combustible liquids, the employer did not install an emergency drainage system in case of spills or accumulation of fire protection water. (a) 275- or 330-gallon totes and 55-gallon drums of flammable or combustible liquids, including Ashland Nuosept 95 Preservative, 2-butoxyethanol, and glycol ether PnB, are stored in the Paint Mixing area. The employer did not install a drainage system to direct, channel, and/or contain released flammable or combustible liquid away from fire or other ignition sources. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
