Text For Citation: 02 Item/Group: 001 Hazard:
29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident. The employer does not report the death of employees when the death is work-related. This violation occurred on or about January 22, 2014, when the employer failed to orally report to OSHA the death of an employee within eight hours. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that all work-related fatalities and in-patient hospitalizations of three or more employees are reported orally to OSHA within 8 hours of the event.
