OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards: Stockroom: Employees were exposed to a fall of 12 feet from top shelf of storage shelf rack to concrete floor below when climbing onto the top shelf of the storage racks from a step ladder. Employees were storing and retrieving boxes (stacked up to 14 feet) on the top shelf.
