Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1910.120(q)(1): The employer, who would evacuate employees from the danger area when an emergency occurred and would not permit any employees to assist in handling the emergency, did not provide an emergency action plan in accordance with 1910.38: a) On or about September 24, 2013-Job site at 130-45 180 th Street Jamaica, NY 11434 At the facility, employees prepare and blend cleaning products using hazardous materials such as, but not limited to, (Sulfuric Acid 93%, Nitric Acid 67%, Oxalic Acid, Sodium Hydroxide, as well as Chemicals such as BTC 2125M-80% and enzyme preparations Savinase 16L, Lipolase 100L). The employer did not implement their Emergency Action Plan, written in accordance with 29CFR 1910.38, when they failed to inform the employees of the specific spill response procedures outlined therein. WRITTEN ABATEMENT CERTIFICATION IS REQUIRED PURSUANT TO 29 CFR 1903.19.
