Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees working in a permit required confined space were exposed to hazards, including fire or explosion, caused by elevated levels of flammable vapors, and/or delayed rescue from a confined space. (a) Location 1095 Hanover St., Manchester, NH: On or about September 9, 2013, employees entered an underground storage tank classified as a permit required confined space when potential hazards (such as fire and explosion) throughout the space were unknown because the air testing being conducted was not done in a manner that represented the atmosphere throughout the confined space where employees worked. (b) Location 1095 Hanover St., Manchester, NH: On or about September 9, 2013, employees entered an underground storage tank classified as a permit required confined space without using a chest or full body harness to facilitate non-entry rescue. (c) Location 1095 Hanover St., Manchester, NH: On or about September 9, 2013, employees entered an underground storage tank classified as a permit required confined space. When a fire broke out in the confined space, a retrieval tripod was used to extract one of the employees; however, it was defective and failed. A support pin in one of the tripod legs had been replaced by a screwdriver secured by a set of locking pliers.
