29 CFR 1910.252(a)(2)(xiii)(B): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, and did not designate an individual responsible for authorizing cutting and welding operations in areas not specifically designed for such processes: On or about July 24, 2013, employees were exposed to fire and explosion hazards at the terminal facility where water hauling tanker trucks were serviced and maintained. The employer did not ensure that a responsible person was designated to authorize welding and cutting operations in areas outside of the welding bay. An example of work in other areas included cutting operations on the truck trailers outside the bay door of the terminal facility. The water hauling tanks, with a capacity such as, but not limited to 130 barrels, were used to transfer and haul liquid waste containing crude petroleum products that contained flammable vapors.
