29 CFR 1910.252(a)(2)(xiii)(A): The employer did not recognize its responsibility for the safe usage of cutting or welding equipment, based on fire potentials of plant facilities, and establish areas for cutting and welding, and procedures for cutting and welding, in other areas: On or about July 24, 2013, employees were exposed to fire and explosion hazards at the terminal facility where water hauling tanker trucks were serviced and maintained. Procedures were needed to designate areas for cutting or welding, and, for performing the cutting and welding work on the water hauling tank truck trailers. The tanks, which had a capacity such as, but not limited to 130 barrels, were used to tansfer and haul liquid waste containing crude petroleum products that contained flammable vapors.
