29 CFR 1960.8(a): The head of each agency did not furnish to each employee employment and a place of employment which were free from recognized hazards that were causing or were likely to cause death or serious physical harm in that employees were exposed to the hazard of being struck by hazardous trees: At the Saddle Back Fire in the Modoc National Forest's South Warren Wilderness, on or about June 10, 2013, U.S. Forest Service management failed to ensure: 1. That Hazard Control measures were implemented as outline under Hazard Tree Safety section on pages 20- 21 of the Incident Response Pocket Guide PMS 461 NFES January 2010, and the following 6 Minutes for Safety topics: Hazard Trees- Situational Awareness, Hazard Tree - No Work Zones (NWZ), Falling Snags, and Hazard Trees. Among other methods, one feasible and acceptable method to correct this hazard is to: 1. Ensure the Hazard Control measures under the Hazard Tree Safety section of the Incidence Response Pocket Guide are considered and are implemented when they can control the hazards. In the Saddleback Fire, the following hazard control measures were not in place: - Avoid hazards by designating No Work Zones (flag, sign, and map). Establish no work zones around the tree, based on 1.5 x the height of the dead tree top, 1.5 x the length of the tree in the direction of the lean, and/or outside of the area on the ground where there is an accumulation of downed limbs. Mark the no work zone with flags. - Post lookouts to help secure high risk areas. Post a lookout whose duties are to keep workers out of the no work zone and to warn workers of falling limbs or tree trunks. Plan escape routes to safe areas in the event limbs or the trunk fall. - Modify suppression tactics or fireline location to avoid high risk areas. When limbs, tree tops, or other debris fall outside of the no work zone, modify the no work zone area to avoid the risk of being struck by the tree.
