OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards from improper gin pole assembly and rigging of a hoisting system for lifting a gin pole to the top of a cell tower. (a) Cell Tower Site - On or about May 28, 2013 employees were exposed to struck-by hazards while working on and near a cell tower and they were not protected by a properly secured top (hook) block used in raising a gin pole. (b) Cell Tower Site - On or about May 28, 2013 employees were exposed to struck-by hazards while raising a gin pole and were not protected by the 2 gin pole sections being assembled with used 5/8" bolt or bolts that they failed to test to ensure that the engineer specified procedure and test were met. (c) Cell Tower Site - On or about May 28, 2013 employees were on and near a tower and exposed to struck-by hazards while raising a gin pole and they were not protected by the gin pole being permanently marked with an identification number that references a specific load chart and gin pole weight.
