29 CFR 1926.451(g)(1)(vii): For all scaffolds not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, each employee is not protected by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section. a) The employer does not require employees to use any form of personal fall arrest systems or the use of guardrail systems while performing bricklaying operations from a tubular welded frame scaffold. This violation was most recently observed at Leverington Ave and Silverwood Street (The Cliff) on or about May 6, 2013, where three (3) employees performing bricklaying operations on the 5th level of the tubular welded frame scaffold were not protected from fall hazards of approximately thirty-two (32) feet by the use of personal fall arrest systems or guardrail systems. To abate this ongoing violation, the employer must provide and require the use of personal fall arrest systems or guardrail systems while employees are utilizing the working levels of the tubular welded frame scaffold. McGee Plastering and Stucco Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 314236092, citation number 1, item number 3 and was affirmed as a final order on 02/27/2012, with respect to a workplace located at Broad & Catherine Street, Philadelphia, PA 19151. McGee Plastering and Stucco Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 314231929, citation number 2, item number 1 and was affirmed as a final order on 02/10/2011 , with respect to a workplace located at 211 Brown Street, Philadelphia, PA 19123.
