OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to large falling glass panes/lites that were placed and moved on a manually operated shuttle/transverse cart operated along fixed tracks/rails between the Bromer Drawer storage rack system and the glass cutting line/table. On or about March 22, 2013, approximately thirteen, 1/4 inch thick, 96 inch wide X 130 inch long, gray tinted glass panes/lites, having a total combined weight of approximately 3,380 pounds, were placed in a nearly vertical manner on the shuttle/transverse cart. The glass panes/lites were not secured and were pulled by an employee towards the glass cutting line. The employee was exposed to and sustained traumatic blunt force trauma injuries when the thirteen glass panes/lites fell off the shuttle/transverse cart over onto the employee while he was attempting to move the shuttle/transverse cart by pulling it from the Bromer storage drawer system to the glass cutting line. Among other methods, feasible and acceptable abatement means to correct this hazard would be to: install the metal safety braces on the front side of the shuttle/transverse cart in order to properly and adequately secure the glass panes/lites to the shuttle/transverse cart; do not allow any employees to walk and/or work on the front side of the shuttle/transverse cart where the glass panes/lites are installed on the cart; require all employees using the shuttle/transverse cart to push and pull the shuttle/transverse cart from only the rear or backside of the cart opposite from where the glass is secured on the cart; and conduct training with all employees using the Bromer Drawer/storage system and shuttle/transverse cart to recognize the hazards associated with using the equipment and the means to minimize and/or eliminate the hazards associated with using the equipment.
