Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational safety and Health Act of 1970. The employer did not furnish to each of his employees employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) On or about 02/17/2013 at the Route 35 Cheesequake Bridge, South Amboy, NJ 08879 an employee was exposed to struck by hazards while clearing stone debris from two cleats used to secure the tug boat known as Devils Bridge to the stone barge. The employee was working under and in close proximity to the extended 22 foot arm of the Komatsu excavator serial number A85474, Model # PC 400LC6LM and did not remain out of the operating area of the excavator bucket, thus exposing the employee to serious injury or death by being struck by the excavator bucket. The hazard posed by working under buckets is plainly obvious; is described in industry safety literature. ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD, AMONG OTHER MEANS, WOULD BE FOR THE COMPANY TO ENFORCE THEIR EXISTING SAFETY AND HEALTH PROGRAM AND PROVIDE ADDITIONAL TRAINING TO EMPLOYEES WHO ARE WORKING IN CLOSE PROXIMITY TO EXCAVATION EQUIPMENT AND ASSOCIATED ACTIVITIES.
