29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c). The employer does not ensure that each employee in an excavation is protected from cave-ins by an adequate protective system. a) This violation occurred on or about December 5, 2012, on the short leg of the trench measuring 8 feet in depth where employees were exposed to crushed-by hazards when grading the depth of the trench without providing a cave-in protection system. b) This violation occurred on or about December 5, 2012, on the long leg of the trench measuring 7 feet, 1 inch in depth where employees were exposed to crushed-by hazards when grading the depth of the trench without providing a cave-in protection system. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that each employee in an excavation is protected from cave-ins by an adequate protective system.
