29 CFR 1926.651(j)(2): Protection was not provided by placing and keeping excavated or other materials or equipment at least 2 feet (.61m) from the edge of excavations, or by the use of retaining devices that were sufficient to prevent materials or equipment from falling or rolling into excavations, or by a combination of both if necessary. The employer does not ensure that excavated materials are kept at least 2 feet from the edge of the excavation. a) This violation occurred on or about December 5, 2012, on the west side of the trench where employees were exposed to struck-by hazards when grading the depth of the trench without moving the spoil pile more than 2 feet from the edge. b) This violation occurred on or about December 5, 2012, on the south side of the trench where employees were exposed to struck-by hazards when grading the depth of the trench without moving the spoil pile more than 2 feet from the edge. Pursuant to 29 C.F. R. 1903.19, within ten (10) calendar days of the abatement date, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that excavated materials are kept at least 2 feet from the edge of the excavation.
