29 CFR 1926.20(b)(1): The employer did not initiate and maintain accident prevention programs as necessary to comply with this part: On or about 06/15/2011, Fabrizi Trucking and Paving Company, Inc. did not implement and maintain an accident prevention program outlining the operational procedures and policies for their employees working around and near excavators equipped with quick couplers. This would address, but not be limited to maintaining safe communication in loud environments; a more standard, universal use of a "top man" (a third employee overseeing an operation and involved in the communication between the equipment operator and the laborer in an excavation); rules for performing ground or other tests that prove attachments are securely attached; and verification of training content and adequacy of training where training is provided by an entity outside the company.
