29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees due to a work-related incident at 675 Scott Road in rural Adair, IL, on or about December 4, 2012, the employer failed to report to OSHA a work-related death/in-patient hospitalization of three or more employees. If you become aware of an incident required to be reported under 1904.39 through some other means other than an employer report, prior to the elapse of the 8 hour reporting period and an inspection of the incident is made, a citation for failure to report will normally not be issued. [Per CPL 02-00-135; II; B. 3] The employer was aware of a work-related incident at 675 Scott Road in rural Adair, IL, on or about December 4, 2012 failed to report to OSHA a work-related death of an employee within 8 hours of the incident.
