29 CFR 1910.1052(k)(1)(iii): The employer did not include methylene chloride in the hazard communication program established to comply with hazard communication standard (HCS) (1910.1200) and did not ensure each employee was trained in accordance with the requirements of HCS and paragraph (l) of this section: a) On or about November 29, 2012, employees were exposed to methylene chloride during permit space entry operations in a 6,000 gallon 16 foot vertical chemical storage tank at Sunnyside Corporation in Wheeling, Illinois. For affected employees, Phoenix Industrial Cleaning, Inc. did not include methylene chloride in their hazard communication program and did not ensure each employee was trained in accordance with the requirements of the hazard communication standard and paragraph (l) of the methylene chloride standard.
