29 CFR 1910.146(d)(4)(viii): Under the permit-required confined space program required by 29 CFR 1910.146(c)(4), the employer did not provide, at no cost to the employees, maintain and ensure the use of rescue and emergency equipment needed to comply with 29 CFR 1910.146(d)(9): a) On or about November 29, 2012, Phoenix Industrial Cleaning, Inc. did not ensure that employee(s) were provided rescue equipment needed to comply with 29 CFR 1910.146(d)(9) prior to the permit space entry into a 6,000 gallon 16 foot vertical chemical storage tank at Sunnyside Corporation in Wheeling, Illinois. This tank was last used by Sunnyside Corporation to store methylene chloride.
