29 CFR 1910.119(j)(5): The employer did not correct deficiencies in equipment that were outside acceptable limits (defined by the process safety information on paragraph (d) of this section) before use or in a safe and timely manner when necessary means where taken to assure safe operation: On or about August 2, 2012, and at times prior thereto, the employer did not correct deficiencies in equipment in a safe and timely manner to assure safe operation exposing employees to the hazard of fire and explosion. While the Unit was operating effluent inlet block valves to the 1E-101 charge/effluent exchangers in the Distillate Hydrotreater Unit developed leaks after the exchangers were removed and returned to service for the purpose of cleaning of the exchanger.
