Text For Citation: 01 Item/Group: 003 Hazard:
29 CFR 1926.59 The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: On or about June 13, 2012, and times prior thereto, the employer did not complete a written hazard communication program to describe how the company would meet the requirements of employee training, gathering MSD sheets and labeling containers. The company did not have MSDSs for chemicals such as cement and had not performed hazard communication training for employees. The five employees are exposed to cement on a daily basis which may cause chemical burns and silicosis. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that a written hazard communication program is prepared and employees are trained on the hazards of the chemicals they work with.
