Text For Citation: 01 Item/Group: 002 Hazard:
29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about June 13, 2012, and times prior thereto, the employer did not provide training to the employees on the hazards of improperly transporting cargo and passengers in a moving vehicle. Employees riding in the back of the pickup truck were not secured in the vehicle to prevent falls and ejection. The hazard was compounded by having the unsecured construction zone hazard signs in the truck bed with the employees. The unsecured cargo could fly out of the bed striking nearby employees or knocking employees out of the truck creating the hazard of being struck by flying objects. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees are trained in the recognition and avoidance of worksite hazards.
