Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to fall hazards from moving vehicles. On or about July 11, 2012, and at times prior there to, employees were picking up and moving construction zone hazard signs. Two of the employees were riding in the bed of the company truck straddling the tailgate with one leg in the truck bed and one leg on the bumper, exposing them to fall hazards. While driving east at approximately 20 miles per hour, a gust of wind caught the signs and threw them into the employees on the bumper, knocking them to the ground. Pursuant to 29 C.F.R. 1903.19, within ten (10) calendar days of the date of this citation, the employer must submit documentation showing that it is in compliance with the standard, including describing the steps that it is taking to ensure that employees ride in the cab of the truck while moving construction zone hazard signs.
