29 CFR 1926.416(a)(3): Before work began, the employer did not ascertain by inquiry, direct observation, or by instruments, whether any part of an energized electric power circuit, exposed or concealed, was so located that the performance of the work could bring any person, tool, or machine into physical or electrical contact with the electric power circuit. JOBSITE: Prior to commencing the "work", the employer did not ascertain through inquiry, direct observation, instruments and/or other means that the overhead electrical wiring that had damaged conduit and exposed live wiring (wiring) was located in close proximity of the work area and ensure through job briefing, instruction and visual observation that the employees, engaged in bringing up and manuevering channel steel beams utilizing mobile scaffolds in and around the wiring to reinforce the existing overhead steel beams were appropriately protected from coming in conatact with the wiring while performaing the above task. On or about 07/12/12, one of employees came in contact with the exposed wiring while performing the above task, and the employee was electrocuted from the incident.
