OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to being pinned under or crushed by a wheel loader. (a) On or about June 28, 2012, and at times prior thereto, a Kawasaki Wheel Loader, 65Z IV, was used for performing maintenance on a semi-trailer without safety procedures including chocking the wheels. (b) On or about June 28, 2012, and at times prior thereto, a Kawasaki Wheel Loader, 65Z IV, was used for performing maintenance on a semi-trailer without safety procedures including applying the parking break. (c) On or about June 28, 2012, and at times prior thereto, a Kawasaki Wheel Loader, 65Z IV, was used for performing maintenance on a semi-trailer without safety procedures including lowering the boom to the ground. (d) On or about June 28, 2012, and at times prior thereto, a Kawasaki Wheel Loader, 65Z IV, was used for performing maintenance on a semi-trailer without safety procedures including stopping the engine.
