Text For Citation: 01 Item/Group: 001B Hazard:
29 CFR 1960.8(a): The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm: a) On, or about June 6, 2012, employees were exposed to the hazard of not being able to receive warnings of approaching trains. The employees were not provided radio or cell phone devices that would insure communication to allow time to warn workers of approaching trains. The radios and cell phones used by the employer were not adequate for the distance and terrain at the worksite to allow workers to be warned about the runaway trailers and to reach a place of safety. One feasible and acceptable method of abatement is to comply with 49 CFR 214.329 which require all workers be given warning in sufficient time to reach safety.
