29 CFR 1915.13(b)(4): Testing was not conducted by the competent person as often as necessary during cleaning or cold work to assure that air concentrations were below 10 percent of the lower explosive limit and within the Permissible Exposure Limit (PEL) and below Immediately Dangerous to Life and Health (IDLH) levels. (a) Aboard the F.V. Clipper Epic, starboard companion way deck; On or about May 17, 2012 an employee died of overexposure to carbon monoxide gases produced from gasoline powered pressure washer engine exhaust. The 8 hour TWA exposure was approximately 555.9 ppm carbon monoxide, which is 11.12 times the OSHA PEL of 50 ppm. The employee was pressure washing paint chips off of the wheel house on the deck and the area was enclosed in plastic and not ventilated. Air monitoring was not conducted to ensure that carbon monoxide levels were kept below the PEL.
