29 CFR 1918.98(a)(1): An employee other than one determined by the employer to be competent by reason of training or experience, and who understands the signs, notices, and operating instructions and is familiar with the signal code in use was permitted to operate a crane, winch, or other power-operated cargo handling apparatus, or any power-operated vehicle, or gave signals to the operator of any hoisting apparatus. OR IN THE ALTERNATIVE, 29 CFR 1910.178(l)(2): PIT operator training did not consist of a combination of formal instruction (e.g., lecture, discussion, interactive computer learning, video tape, written material), practical training (demonstrations performed by the trainer and practical exercises performed by the trainee), and evaluation of the operator's performance in the workplace: a) For employees discharging the vessel Wild Lotus at Berth #12 at Port Manatee (FL), on or about May 14, 2012. On this date, an employee was operating a powered industrial in cargo hold #2 but had not received training specific to the confined working environment of a cargo hold.
