29 CFR 1910.146(c)(4): If the employer decides that its employees will enter permit spaces, the employer shall develop and implement a written permit space program that complies with this section. The written program shall be available for inspection by employees and their authorized representatives. (a) Roggen Farms, 36401 Weld County Road 24 1/2, Roggen, CO 80652: On and before April 11, 2012, the exposing employer did not effectively develop a permit required confined space program which captured the requirements for all spaces at Roggen Farms. Specifically, the employer did not capture the the surgetank located under the mill and accessed by employees periodically to clean. Lack of adequate warnings and enclusion of this space into the confined space program exposed employees to the hazards of a permit required confined space entry in a remote location.
