North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish each of his employees conditions of employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazard: a)Warehouse, bay door 42 - On or about 03/11/2013, the approach plate was bent which contributed to an employee being injured when the forks of the pallet truck contacted the approach plate, causing the hand control arm to swing around, striking the employee and throwing the employee from the truck. NOTE:Among other methods, one feasible and acceptable method of abating this hazard is to remove the plate from service, inspect, and repair/replace the plate as appropriate.
