North Carolina General Statute 95-129(1) of the Occupational Safety and Health Act of North Carolina: The employer did not furnish to each of his employees conditions of employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to struck-by hazards: a) Forest City jobsite, 302 Duke Street, Forest City, NC - Employee was standing approximately 50-feet from a debris pile while the pile was being moved by a CAT 330BL trackhoe when he was struck by a metal pipe at least 70-feet long as it was removed from a debris pile and held by the bucket and thumb of a trackhoe. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to survey the material in the debris pile and ensure that employees are not allowed to be within the possible reach of the material being handled.
