Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ejection from the vehicle in the event of a roll-over resulting in crushing injuries: a) Tunkhannock Ski Slope - An employee operated a John Deere 4720 compact utility tractor without using the seat belt, on or about 10/11/2011. ABATEMENT CERTIFICATION AND DOCUMENTATION REQUIRED Among other methods of abatement, one feasible and acceptable method to correct this hazard is to ensure: (1) Employers develop and implement a program that requires operators of this type of equipment that are equipped with operator restraint devices or seat belts to use the devices. This could include a written program, training, and disciplinary action for lack of use. (2) Enforce the manufacturer's recommendation for use of seat belts when operating with the folding Roll-Over Protective Structure (ROPS) in the upright position to minimize chance of injury from an accident, such as overturn.
