Section 5(a)(1) of the Occupational Safety and Health Act of 1971: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees are exposed to being struck by a moving bus: a)On or about 12/16/2011, Airport passenger bus #ASB 017/VIN #5DF235DA421A3795 was able to be started from the remote start switch located in the rear engine compartment with the transmission shift selector in other than the "neutral" gear position. One feasible and acceptable method of abatement to reduce the hazard is to: a) Follow the requirements set forth in the Federal Motor Vehicle Safety Standards, 49 CFR 571, Standard 102, section 3.1.3 (starter interlock) b)Ensure that the transmission is not in drive or reverse gear prior to the operator exiting the bus c)Ensure that the parking brake is set prior to the operator exiting the bus. d)Provide employee training to ensure paragraphs (a ) through (c ) are followed.
