Text For Citation: 01 Item/Group: 001 Hazard: FALLING
Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer does not furnish employment and a place of employment which are free from recognized hazards that are causing or likely to cause death or serious physical harm to employees in that employees were exposed to falls: a)Service Elevator: The employer allowed employee(s) to be exposed to an elevator that did not have the annual inspection completed. On December 28, 2011 and at times prior thereto, employee(s) were exposed to utilizing a service elevator that did not have the annual inspection completed. The inspection was due on December 14, 2011. Among other methods, one feasible and acceptable method is to ensure that elevators are inspected by an inspector as defined by ASME A17.1-2007 Section 8.11.1.1.1 which states: "Periodic Inspections. Periodic inspections shall be made by an inspector employed by the authority having jurisdiction or by a person authorized by the authority having jurisdiction."
